1. About these terms
These terms are a contract between you and Kleraty Ltd ("Kleraty", "KLERATY", "we", "us"), company number 17133319, registered office Office 1, Izabella House, 24-26 Regent Place, Birmingham, West Midlands, B1 3NJ, United Kingdom. By creating an account or using The Balanx System™ app, you agree to them. If you don't agree, don't use the service.
2. Eligibility and account
You must be at least 18 and able to enter a contract. You're responsible for keeping your login secure and for activity under your account. Give us accurate information and keep it up to date.
3. What the service is
The Balanx System™ provides an app-based skin scan that estimates five cosmetic skin markers from a photo, generates a personalised KLERATY product routine, tracks your progress over time, and offers an AI concierge for guidance. We also sell KLERATY skincare products.
4. Important — not medical advice
The scan, the markers, the protocol, and the AI concierge are provided for cosmetic and informational purposes only. They are not medical advice, diagnosis, or treatment, and are not a substitute for a qualified doctor, dermatologist, or pharmacist. Do not rely on the app for any medical decision. If you have a skin concern that is painful, spreading, bleeding, changing, or otherwise worrying, seek professional medical advice. Results are estimates and may vary with lighting, image quality, and other factors.
5. Purchases, subscriptions and billing
We offer:
- a one-time purchase at £72, including the product kit and a scan/protocol; and
- a Founding Member subscription at £64/month, including re-scans, updated protocols, and progress tracking.
Prices shown are the total amount you pay. Kleraty Ltd is not currently VAT registered, so no VAT is charged. Payment is taken via Stripe. Subscriptions renew automatically each month until cancelled. You can cancel anytime from your account; cancellation takes effect at the end of the current billing period, and access to subscription features ends then. Refunds are governed by our Refund Policy.
6. Acceptable use
You agree not to: misuse or disrupt the service; upload images of anyone without their consent; attempt to reverse-engineer or scrape the app; or use it unlawfully.
7. Intellectual property
The Balanx System™, Dermal Blindness™, the KLERATY name and logo, and all app content are owned by Kleraty Ltd and protected by law. We grant you a personal, non-transferable licence to use the app for its intended purpose. Your scan data belongs to you; you grant us the licence needed to operate the service and produce your results (see the Privacy Policy).
8. Availability
We aim to keep the service running but don't guarantee it will be uninterrupted or error-free. We may change, suspend, or withdraw features, and will give reasonable notice of material changes where we can.
9. Liability
Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by our negligence, or fraud). Subject to that, and because the service is informational/cosmetic, we are not liable for decisions you make based on scan results, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.
10. Ending your use
You can stop using the service and delete your account at any time. We may suspend or end your access if you breach these terms.
11. Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. This does not remove any mandatory consumer rights you have where you live.
